Welcome to GayJaxOnline.com. These Terms of Service govern your access to and use of the GayJaxOnline.com website, member accounts, profiles, social feeds, groups, discussions, events, messaging, media-sharing features, community resources, and related services.

By accessing GayJaxOnline.com, creating an account, or using any part of the service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not access or use GayJaxOnline.com.

1. About GayJaxOnline.com

GayJaxOnline.com is an independently operated online social community serving LGBTQ+ people, allies, organizations, businesses, and community members throughout Jacksonville, Duval County, Northeast Florida, and surrounding areas.

GayJaxOnline.com is not operated by, sponsored by, endorsed by, or officially affiliated with the City of Jacksonville, Duval County, the State of Florida, or any government agency.

2. Adults Only

GayJaxOnline.com is intended exclusively for adults who are at least 18 years old.

By accessing or using the website, you confirm that:

You are at least 18 years old;
You have the legal capacity to agree to these terms;
You are not prohibited by applicable law from using the service; and
The information you provide is accurate and belongs to you.

Anyone under 18 is prohibited from creating an account or accessing members-only areas. Accounts believed to belong to an underage person may be suspended or permanently deleted without advance notice.

3. Member Accounts

Some features require a member account. You agree to provide a valid email address and accurate registration information.

You are responsible for:

Maintaining the confidentiality of your password;
All activity conducted through your account;
Using a secure and unique password;
Keeping your account information current;
Preventing unauthorized access to your account; and
Promptly reporting suspected unauthorized access.

4. Community Conduct

GayJaxOnline.com is intended to be a welcoming and respectful community. Members must respect the privacy, safety, identity, dignity, and personal boundaries of others.

You may not use GayJaxOnline.com to:

Harass, threaten, stalk, bully, intimidate, or abuse another person;
Promote hatred, discrimination, violence, or harm;
Repeatedly contact someone after being asked to stop;
Send unwanted sexual messages or images;
Impersonate another person, organization, business, or public official;
Publish another person's private information without permission;
Distribute spam, chain messages, scams, or deceptive promotions;
Solicit money through fraudulent or misleading claims;
Promote or facilitate illegal activity;
Upload viruses, malware, malicious scripts, or harmful files;
Attempt to access another member's account;
Interfere with the operation or security of the website;
Scrape, harvest, copy, or collect member information without authorization;
Use bots, automated accounts, crawlers, or data-extraction tools without written permission;
Circumvent account restrictions, suspensions, or content controls;
Misrepresent your identity, age, intentions, or affiliation; or
Use the service in violation of applicable law.

5. Profiles, Posts, Photos, Videos, and Other Content

Members may be permitted to create profiles and publish posts, comments, photos, videos, event listings, business listings, group content, discussions, messages, links, and other materials. These materials are collectively referred to as “Member Content.”

You retain ownership of original Member Content that you create. You are solely responsible for your Member Content and the consequences of publishing or sharing it.

By publishing Member Content, you confirm that:

You own the content or have permission to use and publish it;
The content does not infringe another person's rights;
Any identifiable adult shown in the content consented to its publication when consent is required;
The content is accurate when presented as factual information;
The content is not fraudulent, deceptive, defamatory, or unlawful; and
The content complies with these Terms of Service.

6. License to Operate the Service

By uploading or publishing Member Content on GayJaxOnline.com, you grant GayJaxOnline.com a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, process, format, display, transmit, and distribute that content as reasonably necessary to:

Operate and maintain the website;
Display the content according to your selected settings;
Provide social-sharing features requested by you;
Create backups and protect the service;
Investigate reports, fraud, abuse, or security incidents; and
Promote publicly available portions of the GayJaxOnline.com community.

This license does not transfer ownership of your Member Content to GayJaxOnline.com.

The license generally ends when your content is deleted from active systems, except where continued retention is reasonably necessary for backups, legal compliance, security investigations, dispute resolution, or content that another member has independently shared.

Deleting content from GayJaxOnline.com may not delete copies previously shared with another service or saved by another person.

You are responsible for confirming that you have permission to distribute content before sharing it through GayJaxOnline.com.

8. Public and Private Communications

Content published in public profiles, activity feeds, groups, forums, discussions, event pages, or public chat areas may be visible to other members or the general public.

Private messages are intended for their recipients, but complete confidentiality cannot be guaranteed. Recipients may save, copy, screenshot, report, or redistribute messages.

Do not publish or send information that you are unwilling to have viewed or retained by another person.

9. Prohibited Content

The following content is strictly prohibited:

Content involving or appearing to involve anyone under 18;
Sexualized images, discussions, or depictions involving minors;
Nonconsensual intimate images or recordings;
Hidden-camera or secretly recorded sexual content;
Content depicting sexual assault, coercion, exploitation, or trafficking;
Content published without the permission of identifiable participants;
Credible threats or instructions to harm another person;
Content encouraging suicide or serious self-harm;
Content involving sexual activity with animals;
Fraudulent financial offers or investment schemes;
Malware, phishing links, or credential-stealing content;
Stolen copyrighted material;
Content intended to expose another person's private information; and
Any content prohibited by applicable law.

Adult-oriented content may only be posted in areas where it is expressly permitted and must comply with all applicable content labels, visibility restrictions, community rules, and legal requirements.

10. Local Events, Organizations, and Business Listings

Members may be permitted to publish information about local events, organizations, venues, businesses, services, and community resources.

Unless specifically stated, GayJaxOnline.com does not own, organize, sponsor, manage, inspect, or endorse third-party events, businesses, products, services, organizations, or venues listed on the website.

The person submitting a listing is responsible for ensuring that the information is accurate, lawful, current, and authorized.

GayJaxOnline.com does not guarantee event schedules, admission requirements, prices, availability, accessibility, safety, product quality, business practices, or the accuracy of third-party listings. Members should confirm important details directly with the event organizer, business, or venue.

11. Advertising and Commercial Activity

Businesses, organizations, promoters, and members may not post repetitive advertisements, mass solicitations, referral schemes, or unrelated promotional content without authorization.

Commercial posts must be truthful and must clearly disclose material conditions, prices, sponsorships, or paid relationships when required.

GayJaxOnline.com may remove promotional content or restrict accounts that misuse community features for advertising, spam, or solicitation.

12. Member Safety and In-Person Meetings

GayJaxOnline.com does not perform comprehensive identity, criminal-history, health, employment, or background checks on every member.

We do not guarantee that a member's identity, profile, photographs, statements, intentions, or representations are accurate.

You are responsible for exercising reasonable judgment when communicating with members or arranging in-person meetings.

Members should consider the following safety practices:

Meet new people in a public location;
Tell a trusted person where you are going;
Use your own transportation;
Protect your home address and financial information;
Do not send money, gift cards, passwords, or banking details;
Respect another person's boundaries and consent;
End communication when another member makes you uncomfortable; and
Contact emergency services when immediate danger exists.

GayJaxOnline.com is not an emergency service. Reports submitted through the website may not be reviewed immediately.

13. Moderation

GayJaxOnline.com may, but is not required to, monitor, review, investigate, restrict, hide, remove, preserve, or restore Member Content.

We may take action when we reasonably believe that content or conduct:

Violates these Terms of Service;
Creates a safety, privacy, legal, or security risk;
Interferes with the operation of the website;
Is associated with fraud, spam, harassment, or abuse;

15. Blocking and Member Disputes

Members may use available blocking, muting, privacy, and reporting tools to manage interactions with others.

GayJaxOnline.com is not obligated to mediate personal disagreements, relationship disputes, business disputes, or disagreements arising from offline interactions.

We may intervene when a dispute involves threats, harassment, fraud, privacy violations, prohibited content, service misuse, or a potential violation of these terms.

16. Copyright and Intellectual Property

You may not upload, reproduce, distribute, or publish content that infringes another person's copyright, trademark, publicity rights, or other intellectual property rights.

That the service will meet every member's expectations;
That content will always remain available; or
That use of the website will produce friendships, relationships, business opportunities, or other particular outcomes.

23. Limitation of Liability

To the fullest extent permitted by applicable law, GayJaxOnline.com and its owner, operator, administrators, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to:

Your use of or inability to use the service;
Member Content or communications;
The conduct of another member;
An in-person meeting or offline interaction;
A third-party event, business, organization, venue, product, or service;
Unauthorized access to your account;
Loss of content, information, or data;
Social sharing or third-party services;
Service interruptions or technical failures; or
Reliance on information published through the website.

To the extent permitted by applicable law, legal proceedings arising from these terms or the use of GayJaxOnline.com must be brought in a court of competent jurisdiction located in Duval County, Florida.

Before filing a legal claim, you agree to make a reasonable, good-faith effort to resolve the dispute by contacting GayJaxOnline.com and describing the issue.

Nothing in this section prevents either party from seeking urgent legal relief when reasonably necessary to prevent immediate harm.

26. Changes to These Terms

We may update these Terms of Service when the website, its features, community standards, business practices, or legal obligations change.
